Summary draft amendment of the "Plant Protection and Quaratine Act" |
| Summary |
The relevant regulations of the "Plant Protection and Quarantine Act" (hereinafter referred to as "the Act") are drafted for amendment. In this draft amendment, six articles are revised. The contents of the revised articles are:
1. Three articles are adjusted in the hierarchy of the phytosanitary rules in order to improve the regulatory framework of plant protection and quarantine;
2. The intended purposes of importation for the designated plant regulated articles in Article 15 are revised because of consideration of the demand for utilizing the designated regulated articles or other articles (such as patent microorganisms, biological control agents, pollinators and as raw material for producing other items with no quarantine risk) of industries and for plant protection purpose. In addition, the requirements for risk assessment and management shall be established by the central competent authority;
3. The requirements for regulated articles that are imported by mail are revised;
4. The penalty in Article 24 is revised.
