1. The notified text establishes phytosanitary requirements for the importation,
temporary admission and transit of used machinery.
2. Used machinery shall be understood to mean the following: agricultural, forestry,
gardening and earth-moving machinery, equipment, tools and parts thereof, waste
compactors, and any other machinery designated by the Service, in accordance with
the associated phytosanitary risk.
3. Used machinery entering national territory, whether imported or admitted temporarily,
must be clean and free of soil, plant remains and regulated pests. To this end it must
be cleaned inside and out, in the country of origin, using a pressure washer, steam, forced or aspirated air, or another appropriate method, with parts being disassembled if necessary.
4. Where used machinery in closed containers, not for deconsolidation, is transiting through national territory and destined for a third country, the containers must remain
sealed during their journey through national territory. This will be checked by Service inspectors. In cases where used machinery does not enter in closed containers or is to
be deconsolidated in Chilean territory, it must comply with the same requirements established for imported used machinery.
5. Importers will be responsible for:
a) Complying with the requirements established in this Resolution;
b) Covering the costs of any phytosanitary measures deemed necessary by the Service as a result of non-compliance with the provisions of this Resolution;
c) The return shipment of used machinery that is rejected within the time-frames established by the Service.
6. The wood packaging and the packing materials used must comply with the specific phytosanitary regulations governing their entry into the country.
7. Shipments will be physically inspected upon their arrival in the country by Service inspectors at the point of entry, so as to verify compliance with the phytosanitary requirements. Where an inspection detects non-compliance with the established requirements, or non-regulated pests, phytosanitary risk management measures will be applied in accordance with the identified risk.
8. The notified text repeals Resolution No. 2.979 of 2001 laying down phytosanitary regulations governing the entry into Chile of used agricultural machinery.
