The draft circular removes aquaculture products from the scope of Circular 48/2012/TT-BNNPTNT (as amended by Circular 06/2018/TT-BNNPTNT), which governs certification of products made in line with Good Agricultural Practices (VietGAP). After the change, the circular will cover livestock products only.

Article 2. Repeal of phrases
1. Repeal the phrase "aquaculture," in the legal basis for promulgation of the Circular.
2. Repeal the phrase "aquaculture," in Article 1; in clauses 2, 3, and 5 of Article 2; and in Appendix II.
3. Repeal the Clause 1 of Article 4.
4. Repeal the phrase "aquaculture, aquatic animal health, and biology for the aquaculture sector;" in point a, clause 1, Article 6.
5. Repeal the phrase "products in the aquaculture sector;" in clause 1, Article 16.
6. Repeal the phrase "Appendix IXA," in clause 1, Article 16.
7. Repeal the phrase "Directorate of Fisheries," in point b, clause 4, Article 17.
8. Repeal the code "CGDG-VietGAP-TS 01/" in Appendix I.
9. Repeal the phrase "Aquaculture (TS)" and the phrase "The code of the first VietGAP certification body designated in 2012 by the Directorate of Fisheries is VietGAP-TS-12-01" in Appendix VII.
10. Repeal the Appendix IXA.
Article 3. Implementation provisions
This Circular takes effect from ______ 2026.
Article 4. Transitional provisions
1. Decisions on designating VietGAP certification bodies which issued by the Directorate of Fisheries (now the Department of Fisheries and Fisheries Surveillance) under Circular No. 48/2012/TT-BNNPTNT shall ceasee to be effective when this Circular takes effect.
2. VietGAP certificated for aquaculture products which issued under Circular No. 48/2012/TT-BNNPTNT before this Circular takes effect may continue to be used until the expiry date stated on the VietGAP certificate.
This Circular now covers only the livestock sector
VietGAP certification bodies in aquaculture will operate in accordance with the regulations set forth in Decree No. 22/2026/ND-CP, issued by the Government on 16 January 2026.
