| Summary |
The draft Decree amends, supplements a number of articles of Decree 38/2026/NĐ-CP issued on 24 January 2026 by the Government promulgating import of soil ball plants and production unit codes, packing house codes:
i) Ensure the compliance with the ensure constitutionality, legality, consistency, and coherence in the formulation of detailed regulations on granting and management of production unit codes, packing house codes, which are prescribed in Article 64 of the Law on Crop Production 31/2018/QH14 amended, supplemented by Law 146/2025/QH15;
ii) Ensure the decentralization and authority delegation, practical simplification of administrative procedures, publicity, transparency; no new administrative procedures created, no new components in a dossier created, facilitation for organizations, individuals but fulfillment of the State management requirements;
iii) (iii) Promote application of information technology, deal with administrative procedures in the electronic environment; strengthen decentralization, in close relation with post-examination mechainism and enhanced responsibilities of organizations, individuals during the implementation;
iv) (iv) Ensure compliance with the relevant legislation, match with crop production conditions in Viet Nam, meet requirements of importing countries for export production units, packing houses for, contribute to raising competitiveness of Vietnamese agricultural products;
v) (v) Link the simplification of administrative procedures with the enhancement of responsibility for self-declaration, self-acccountability of organizations, individuals to; and, with post-examination, inspection, examination of of the State management agencies, and settlement of untruthful declaration cases or violations.
The draft Decree aims to reduce, simplify administrative procedures, business investment conditions, decentralization, update processes and forms.
